Dick’s SAMPLE - MONTH TO MONTH RENTAL AGREEMENT
and
SAMPLE payment and maintenance information
On this day XXX XX XXXX, we Latee Daa, landlord and Latee Dee and Latee flea, tenants, agree to a month to month rental for the front house/apartment located at 112 Princeton St., Santa Cruz CA. 95060 which does NOT include the use of or entry into the garage for any purpose. The month to month rental period will begin on Someday. This rental agreement may be terminated at any time, by either party, by giving the other a written notice, 30 days in advance.
The tenant agrees to pay $1300.00 rent per month.
Late charges of $5.00 per day for rental payments not paid to the landlord by the first day of each month shall accrue and be paid to the landlord with the late rent.
A security deposit of $2000.00 shall be paid with the first month's rent. This security deposit is NOT "last months rent", rather it is to be used by the landlord to remedy any potential default or breech by the tenant. This could include but not limited to: non payment of rent and/or late charges, repair of damage caused by the tenant or by a guest or pet of the tenant, to clean the premises as necessary upon termination of the tenancy, to replace or return personal property, to pay for arrears owed for utilities, etc.
Attorney's fees can be collected from the losing party in the event of a lawsuit between tenant and the landlord.
All payments except the first are to be made payable to landlord according to the attached "Rental payment, plumbing and maintenance" page.
The tenant agrees to pay all utilities, to include gas and electric, water, garbage and sewer for both the front and back residences.
The landlord does provide routine yard maintenance: this is not to imply though, that the tenant can't do additional yard maintenance if they so desire.
The storm windows provided must be installed by the tenant as first winter storm approach central California.
NO PETS are to be kept on or about the premises without the landlord’s WRITTEN consent.
The tenant shall NOT paint, wallpaper, add or change locks or otherwise make alterations without the landlord’s prior written consent.
The tenant shall NOT let or sublet all or any part of the premises nor assign this agreement or any interest in it.
The landlord or their agent is given the right to enter and inspect the premises a) in case of an emergency or b) after having given the tenant 24 hours notice if the intention to do so.
The tenant will provide for their own insurance for tenant owned items.
The samples are hereby noted; received, read, understand and agree to all the above and the attached "Sample Rental payment, plumbing and maintenance".

Rental payment, plumbing and maintenance Sample
1. Payments for rent are to be made out to me (Richard Brooke), and, on the back of the check print "FOR DEPOSIT ONLY"," 12345678" (2 lines), complete a deposit slip, and mail both to:

2. Mailing of the checks to be timed to arrive at the above by the 1st (first) of each month. Include late charges based on the payment's projected arrival.
3. Any "general" maintenance needs/problems should be directed to me or if I am unavailable directly to :

4. If (when) you have plumbing problems, and Tim J. is unavailable, consult with me before calling the plumber. A certain degree of reasonableness on your part should be observed (a leaky washer cost 25 cents to buy, and $80.00 for a plumber to install, yet a leaky faucet should not go on forever). Plugged drains, on the other hand, should be fixed as soon as possible. The plumber(s) to call is:

NOTE though that if the plumber is called and comes to the house for a repair only to find no one home then charges for that house call, the tenant will be responsible for the payment of that house call!!
5. I will reimburse for any phone calls made to me by any tenant, although a copy of a receipt will by required.
