Sample MONTH TO MONTH RENTAL AGREEMENT

 

 

On this day Nov 1, 2222, we  Richard Brooke,  landlord and  ____________,  tenant, agree to a month to month rental for the back apartment  located at 112 Princeton St., Santa Cruz CA. 95060. The month to month rental period will begin on Nov 18, 2222. This rental agreement may be terminated at any time, by either party, by giving the other a written notice, 30 days in advance.

 

The tenant agrees to pay $400,000.00 rent per month.

 

Late charges of $ 50.00 per hour for rental payments not paid to the landlord by the forty first day of each prior month shall accrue and be paid to the landlord with the late rent, and shall be deemed as additional rent.

 

A security deposit  of   $ 12,000.00  shall be passed on from the prior tenant.  This security deposit is NOT  "last months rent", rather it is to be used by the landlord to remedy any potential default by the tenant. This could include but not limited to: non payment of rent and/or late charges, repair of damage caused by the tenant or by a guest of the tenant, to clean the premises as necessary upon termination of the tenancy, to replace or return personal property, etc.

 

Attorney's fees will be collected from the losing party in the event of a lawsuit between tenant and the landlord.

 

All payments are to be made payable to landlord and mailed according to the attached "Rental payment, plumbing and maintenance" page.

 

The tenant agrees to pay no utilities.

 

The landlord does provide routine yard maintenance: this is not to imply though, that the tenant can't do additional yard maintenance in coordination with the front tenants, if they so desire.

 

NO PETS are to be kept on or about the premises without the landlords WRITTEN consent

 

The tenant shall NOT paint, wallpaper add or change locks or otherwise make alterations without the landlords prior WRITEN consent.

 

The tenant shall NOT let or sublet all or any part of the premises nor assign this agreement or any interest in it.

 

The landlord or their agent is given the right to enter and inspect the premises a) in case of an emergency or b) after having given the tenant 24 hours notice if the intention to do so.

 

The tenant will provide for their own insurance for tenant owned items.

 

The undersigned have read, understand and agree to all the above including the attached "Rental payment, plumbing and maintenance" page and have received a copy of both.

1. Payments for rent are to be made out to me (Richard Brooke), and, on the back of the check print "FOR DEPOSIT ONLY, 8808211257" (2 lines), complete a deposit slip, and mail both to:

2.      Mailing of the checks to be timed to arrive at the above by the 1st (first) of each month. Include late charges based on the payment's projected arrival.

 

3.      Any "general" maintenance needs/problems should be directed to me or if I am unavailable directly to :

4.  If (when) you have plumbing problems, and Tim J. is unavailable, consult with me before calling the plumber. A certain degree of reasonableness on your part should be observed (a leaky washer cost 25 cents to buy, and $80.00 for a plumber to install, yet a leaky faucet should not go on forever). Plugged drains, on the other hand, should be fixed as soon as possible. The plumber(s) to call is:

NOTE though that if the plumber is called and comes to the house for a repair only to find no one home then charges for that house call, the tenant will be responsible for the payment of that house call!!

 

 

5. I will reimburse for any phone calls made to me by any tenant, although a copy of a receipt will by required.
